Acceptable Use Policy
This Acceptable Use Policy explains how Local Reputation Tool may and may not be used. It is intended to protect message recipients, customers, third-party service providers, review platforms, and the security and reputation of our Services.
This policy is part of our Terms and Conditions. By accessing or using Local Reputation Tool, you agree to follow this policy and ensure that your employees, authorized users, contractors, and anyone using your account also comply with it.
Local Reputation Tool is a service of Web Design by Daniel Sanchez, based in Porterville, California.
Permitted Use
Local Reputation Tool may be used for legitimate business reputation-management activities, including:
- Monitoring authentic reviews from supported third-party review platforms
- Requesting reviews or feedback from customers following a genuine purchase, appointment, transaction, or completed service
- Sending reasonable follow-up reminders relating to a review or feedback request
- Responding to authentic customer reviews
- Displaying authentic reviews through website widgets
- Receiving reputation reports, account notices, and service notifications
- Using approved automation and artificial-intelligence features for legitimate reputation-management purposes
Local Reputation Tool is not a cold-email, lead-generation, or unsolicited bulk-marketing platform. It is intended primarily for communications with genuine customers and other recipients whom the sender is lawfully permitted to contact.
Email and Recipient Requirements
You are responsible for every recipient, message, and communication initiated through your account. You must have an appropriate legal basis and any consent required by applicable law or provider policy before contacting a recipient.
You agree that you will:
- Contact only recipients you are legally permitted to contact
- Use review requests only in connection with genuine customer experiences or legitimate business relationships
- Only upload or submit contact information for genuine existing customers from an active or recent business relationship — typically within the past 12 months
- Obtain affirmative consent when required by applicable law, regulation, or email-provider policy
- Maintain adequate records showing how and when consent was obtained when consent is required
- Clearly identify the business responsible for sending each message
- Use accurate sender names, email addresses, domains, reply-to addresses, and subject lines
- Include an effective unsubscribe or opt-out method whenever required
- Include any physical mailing address, privacy-policy link, or other disclosure required by applicable law or provider policy
- Promptly honor unsubscribe requests, complaints, consent withdrawals, and suppression-list entries
- Comply with the CAN-SPAM Act and all other laws and industry standards applicable to your communications
An existing customer relationship does not automatically satisfy every consent requirement. You are responsible for determining whether a particular review request, reminder, or other message is legally permitted.
Prohibited Email and Messaging Practices
You may not use Local Reputation Tool to:
- Send spam, unsolicited bulk email, or unwanted commercial communications
- Conduct cold-email campaigns or indiscriminate mass outreach
- Send messages to purchased, rented, leased, borrowed, traded, or shared contact lists
- Send messages to scraped, harvested, appended, guessed, or automatically collected email addresses
- Use third-party lists unless each recipient has provided legally sufficient consent to receive messages from the business identified as the sender
- Send to generic or role-based addresses without proper authorization, including addresses such as info@, support@, admin@, or webmaster@
- Contact recipients who have unsubscribed, complained, withdrawn consent, or requested that communications stop
- Bypass, remove, alter, or interfere with unsubscribe mechanisms, suppression lists, complaint controls, or sending restrictions
- Use false, deceptive, misleading, forged, or unauthorized sender information
- Use misleading subject lines or conceal the identity of the business initiating the communication
- Impersonate another person, company, organization, or domain
- Send phishing messages, fraudulent requests, scams, malware, or deceptive links
- Generate email bounce rates exceeding 5% or spam complaint rates exceeding 0.1% as reported by our upstream email service providers. Exceeding these thresholds constitutes a material breach of this policy and may result in immediate account throttling or termination to protect the deliverability and reputation of our shared sending infrastructure
- Generate excessive spam complaints, invalid-address bounces, blocks, or other deliverability problems
- Attempt to evade email allowances, rate limits, account restrictions, provider policies, or enforcement measures
- Utilize contact data for SMS or text messaging features unless you possess explicit, documented prior express written consent from the recipient specifically authorizing mobile text communications. An existing customer relationship or email consent alone is not legally sufficient to send SMS or text messages under the Telephone Consumer Protection Act (TCPA)
Review Collection and Authenticity
Review requests must be based on genuine customer experiences. You must use neutral selection criteria, such as completion of a transaction, appointment, purchase, or service.
You may not use the Services to:
- Request reviews from individuals who did not genuinely interact with the business
- Create, purchase, sell, arrange, coordinate, or submit false or misleading reviews
- Ask employees, contractors, family members, or other affiliated persons to post reviews without appropriate disclosure
- Offer compensation, gifts, discounts, free products, services, or other incentives in exchange for a positive review or a particular star rating
- Condition an incentive on a customer expressing a positive or negative sentiment
- Offer any permissible generic incentive for feedback — such as a discount, entry into a drawing, or loyalty reward — without ensuring that recipients are explicitly instructed to disclose the incentive within the text of any public review they submit. Failure to require and facilitate this disclosure may violate the Federal Trade Commission (FTC) Endorsement Guides and similar regulations
- Pressure, threaten, harass, intimidate, or improperly influence someone regarding a review
- Require a customer to revise or remove an honest negative review
- Submit multiple reviews through different accounts for the same experience
- Use automated accounts, fabricated identities, or coordinated activity to manipulate ratings
- Violate the policies of Google, Facebook, Yelp, or another review platform
- Hold Local Reputation Tool or Web Design by Daniel Sanchez liable for any account suspensions, listing removals, review deletions, penalties, or other actions imposed on your business by third-party platforms including Google, Yelp, and Facebook resulting from your use of these Services. You assume all operational and legal risks associated with third-party platform terms of service, policies, and algorithmic decisions. Third-party review platforms have absolute and unilateral control over their own listings, ratings, and business profiles, and Local Reputation Tool has no ability to prevent, reverse, or influence any action taken by those platforms
No Review Gating
Local Reputation Tool does not provide review-gating functionality that directs customers to different destinations based on whether their feedback is positive or negative.
You may not attempt to recreate review gating outside the Services or use another process to selectively request public reviews only from customers expected to provide favorable feedback.
You may collect private customer feedback, but you may not use that feedback to prevent dissatisfied customers from receiving the same opportunity to leave a public review that is provided to satisfied customers.
Website Review Widgets
The Services may allow authentic reviews from third-party platforms to be displayed through widgets on your website.
Hiding a review from a website widget does not remove, edit, suppress, or otherwise affect the original review on Google, Facebook, Yelp, or another third-party review platform.
You agree to hide a review from a website widget only for a legitimate moderation reason, such as:
- Obscene, vulgar, threatening, hateful, harassing, or abusive language
- Spam, advertising, solicitations, or irrelevant material
- Personal, confidential, sensitive, or identifying information
- Duplicate, corrupted, or incorrectly imported content
- Content unrelated to an actual customer experience
- Content that violates applicable law or the original review platform's policies
You may not hide a review solely because it:
- Has a low star rating
- Contains criticism
- Expresses disappointment or dissatisfaction
- Reflects unfavorably on the business
- Describes a genuine negative customer experience
You may not use widget-display or moderation controls to create a false or materially misleading impression of overall customer sentiment.
You must not claim that a widget displays every review, an unfiltered review history, or all customer feedback unless that statement is accurate.
Artificial Intelligence Features
Local Reputation Tool may provide artificial-intelligence-assisted review replies, summaries, analysis, prompts, or generated content.
You may not use AI features to create or publish:
- False, deceptive, defamatory, discriminatory, or unlawful statements
- Fake reviews or fabricated customer experiences
- Misleading claims about a customer, competitor, product, or service
- Content that impersonates another person or business
- Threatening, harassing, hateful, obscene, or abusive content
- Content that violates intellectual-property, privacy, publicity, or other third-party rights
- Content that violates a review platform's rules or policies
AI-generated content may contain errors or may not be appropriate for every situation. You remain responsible for content posted through your account, including automatically generated or automatically published replies.
Prohibited Content and Conduct
You may not use the Services to create, upload, transmit, store, display, or distribute content that:
- Violates any applicable law, regulation, court order, or legal obligation
- Is fraudulent, deceptive, defamatory, threatening, harassing, hateful, discriminatory, obscene, or abusive
- Promotes violence, illegal conduct, exploitation, or harm
- Infringes intellectual-property, privacy, publicity, confidentiality, or other third-party rights
- Contains malware, viruses, ransomware, spyware, malicious scripts, or harmful code
- Attempts to obtain passwords, financial information, account credentials, or other sensitive information through deception
- Misrepresents the identity, affiliation, authority, or endorsement of a person or organization
Security and Platform Integrity
You may not:
- Access or attempt to access an account, system, integration, network, or data without authorization
- Probe, scan, test, circumvent, disable, or interfere with platform security
- Reverse engineer, decompile, disassemble, decode, or attempt to obtain source code except where applicable law expressly permits
- Interfere with the availability, performance, or proper operation of the Services
- Use bots, scripts, automated tools, or excessive requests in a way that burdens or disrupts the Services
- Attempt to evade rate limits, plan restrictions, account limits, or usage allowances
- Create multiple accounts to bypass suspensions, restrictions, trials, fees, or sending limits
- Share login credentials with unauthorized persons or exceed the number of users allowed by your plan
- Use the Services to test stolen credentials, validate improperly obtained contact information, or facilitate unauthorized activity
- Resell, sublicense, white-label, or commercially redistribute the Services without our written permission
Third-Party Platforms and Providers
Your use of Local Reputation Tool may involve third-party services such as Google, Microsoft, Facebook, Yelp, Twilio SendGrid, EmbedMyReviews, Stripe, and other review, email, infrastructure, analytics, or integration providers.
You must comply with the applicable terms, acceptable-use rules, technical requirements, content policies, and privacy requirements of each third-party service you use through or in connection with Local Reputation Tool.
Conduct that causes or may cause Local Reputation Tool, our providers, or another customer to lose access to a third-party service is prohibited.
Third-Party Platform Risk. Google, Yelp, Facebook, and other review platforms maintain absolute and unilateral control over their own listings, business profiles, ratings, and review content. Local Reputation Tool has no ability to guarantee the availability, accuracy, or continuity of any third-party platform listing. You acknowledge and accept all risks associated with third-party platform policies, algorithmic changes, and enforcement decisions, and agree that Local Reputation Tool bears no liability for any action taken by a third-party platform in connection with your use of these Services.
Deliverability Standards and Enforcement Thresholds
To protect the email deliverability and sending reputation of all customers on our platform, we monitor account-level sending metrics including bounce rates, spam complaint rates, unsubscribe rates, and engagement patterns.
You agree to maintain sending quality standards consistent with industry best practices, including:
- Keeping hard bounce rates below 5% of total emails sent in any rolling 30-day period
- Keeping spam complaint rates below 0.1% of total emails sent as reported by email providers including Google and Microsoft
- Maintaining a valid and current suppression list and honoring all opt-outs within the timeframes required by applicable law
- Sending only to contacts with whom you have a genuine, recent, and verifiable business relationship
Accounts that exceed these thresholds or that generate patterns consistent with spam, list abuse, or low-quality sending may be throttled, restricted, or terminated immediately and without prior notice in order to protect our sending infrastructure and other customers on the platform.
Monitoring and Enforcement
We may monitor usage patterns, message activity, bounce rates, spam complaints, unsubscribe activity, account behavior, review moderation patterns, and other information reasonably necessary to protect the Services and enforce this policy.
We may investigate suspected violations and may require you to provide information such as:
- The source of a recipient list
- Evidence of recipient consent
- The date, method, wording, and scope of an opt-in
- A sample of messages sent through your account
- An explanation of unusually high bounce or complaint rates
- Information concerning review requests or widget moderation activity
- Corrective steps taken in response to a compliance concern
If we believe you have violated this policy, our Terms, applicable law, or a provider requirement, we may take one or more of the following actions:
- Issue a warning or request corrective action
- Limit, block, or pause email sending
- Add recipients or addresses to a suppression list
- Disable an integration, automation, campaign, widget, or feature
- Restrict account users or usage allowances
- Remove or restrict unlawful or abusive content
- Suspend or terminate an account
- Preserve or disclose information when required by law
- Cooperate with third-party providers, regulators, law enforcement, or other authorized parties
We may take immediate action without advance notice when reasonably necessary to prevent spam, fraud, security threats, legal violations, harm to recipients, damage to deliverability, or disruption of a third-party provider relationship.
Reporting Abuse
If you receive an unwanted, deceptive, abusive, or suspicious message sent through Local Reputation Tool, or believe someone is misusing the Services, please contact us at hello@localreputationtool.com.
Please include any available information that will help us investigate, such as:
- The name of the sending business
- The sender's email address
- The date and approximate time of the message
- The message subject
- A screenshot or copy of the message
- A description of why you believe the communication or activity violates this policy
Changes to This Policy
We may update this Acceptable Use Policy periodically to reflect changes in our Services, provider requirements, industry practices, or applicable law.
We will post the revised policy on our website and update the "Last updated" date above. Material changes may also be communicated through the Services or by email.
